Framing RTI: PF Pune FAA has not replied-need to escalate

Dear Sir,

After leaving my earlier job, I have applied for withdrawal of my PF by submitting duly filled and signed application form on 19th April 2011. Since the amount didn't get credited for more than 3 months I filed and RTI application to PF commissionar Pune office.

However after 30 days I got a reply from them saying that my application was not received by their Unit 7. Since I my RTI application was addressed to CPIO of PF commisssionar office and not any particular unit or subunit within their office. In the meanwhile I had visited the PF office Pune personally and I have seen my application was very much received by them, I could even see the amount to be credited in my account on one of the computers kept for this purpose in their office.

Afterwards I filed an application seeking redressel to the First Appellate Authority but there is no response/communication from his end.

Now, after waiting for 40 days I have decided to escalate this matter through RTI. Kindly help me with following points.

• With whom should I file my complaint? Do I need to file a complaint with SIC/CIC?

• Since the information provided to me was false/malafide and untrue, what remedies I have under RTI against the CPIO.
  
• What action against RTI can be taken against FAA as he didn't rectify the mistakes of CPIO and nor did he reply in due timeframe?

• In how many days I should expect a reply/information about next process from SIC/CIC?

Kindly help me in drafting an appropriate appeal on this issue.

You can efile complaint by visiting www.rti.india.gov.in. I hope you would have mailed papers for withdrawal to PF Office by speed or registered AD post. Hence you can provide copy of postal receipt or acknowledgement received with complaint. Please also refer:

You have to narrate entire story in complaint and enclose RTI application, reply, first appeal etc .

CPIO of PF Office is CPIO of entire PF organisation in India and he cannot confine to particular section or unit or dept. or office. He must hunt for the information in the entire organisation in the world and provide to you. CPIO is evasive and has failed in his quasi-judicial and statutory duties enjoined on him under RTI Act.

Whether you efile or send hard copies, do send copies to CPIO and FAA so that they may act as per provisions of RTI rather than face music to CIC.

Please visit www.epfindia.nic.in and try if it shows status of your case. If it shows, send screen shot to CIC with complaint.

Thanks for your valuable guidance. Sorry, I couldn't reply earlier as I was out of state for some business needs.

I have filed an appeal with CIC online on this website http://rti.india.gov.in/ today. However it was giving a message saying 'Action-Status : Signed copy awaited'.

Can you please guide me on this. What does this mean.

i. Do I need to send the signed copies of all my complaint?
ii. Do I need to send the signed copies of all the documents I have uploaded while filing this complaint?
iii. Also kindly let me know if there are any other formalities to be done.

Please guide me in a bit detail so that we can make sure justice is done and erring and non-performing officers at PF office does not escape this time.
