    DoPT circular on "advice" and "opinion" based on SC judgment

    Attached is the DoPT circular dated 16 Sep 2011 regarding "advice" and "opinion" sought by RTI applicants. This is based on observations made by the Supreme Court in the Answer sheets case.

    This means that public authority cannot summon information from private entities under section 2.f as it will amount to collection of information.

    The word used in Sec 2(f) is "accessed" and not "collected". They are two entirely different things.

    One must remember that, if public authority concerned , is supposed to maintain the desired information by any existing law ,THE DEPTT. WILL NOT ONLY BE NEGLIGENT IN KEEPING RECORDS BUT ALSO LIABLE FOR FAILURE OF PERFORMING IT'S LAWFUL DUTIES....
