Answered: Appeal to ChiefInformation Commission

Sir ,
Can an appeal be filed before the Chief information Commission against the order of Information Commissioner , This is what I read in one of the reply given by some friend here and if yes under what circumstances?

A review is possible if you can prove an “Error of law apparent on the face of record or an error of facts”.

If you are able to convince the CIC that an order was obtained by fraudulent means/by misrepresenting facts or there is an error from legal point of view a review can be asked for.

Otherwise there shall be no review or recall of any decision. Please see this thread.

Then Sir, what the Chief information Commissioner will be doing ,can he not form a bench of Commissioner to decide an issue so that the question be put before a larger bench to settle apoint so that conflicting judgements may not come from the commissioner and there be uniformaty.

That should be the norm.

Have a look at this post that is somewhat similiar to what have mentioned.
