RTI rules of many states are inconsistent with the letter and spirit of the RTI Act. Let us use this thread to make a collection of all inconsistencies in the rules of different states. May be we can individually plan some action on this at a later date. |

Let me begin with Arunachal Pradesh. 1) There are specified forms for every communication under the RTI Act. While forms are usually optional, here it is compulsory to file in the specified format. 2) "If information does not pertain to that authority, it will return the application between 15 to 30 days, in Form B and the application fee will NOT be refunded." This is direct violation of Sec 6(3). 3) "Information to be provided in Form D between 15 to 30 days of application receipt" Nothing in the Act stops the PIO from providing information earlier than 15 days. In fast information is to be provided as expeditiously as possible. 4) Application fee is Rs 500 for bids/tenders etc. and Rs 50 in other cases. Charge for photocopy is Rs 5 per page. Clearly not in harmony with the spirit of the Act. 5) "If information is not provided or rejection is not communicated within 30 days, a penalty of Rs. 50.00 per day subject to a maximum of Rs. 500.00 will be levied. If the information supplied is false, the penalty shall be Rs. 1000.00" Beyond the scope of matters for which rules may be made and a direct violation of Sec 20 of the Act. |

law maker should not leave all these rules for the states to make when we are the citizen of one country the law should be uniform. By allowing the states to frame rules of any act they leave loop holes and in this way states make the rules which are convenient to them and a very good law becomes mockery .Through out the country the law should be one as in case of CRPC,IPC CPC etc. |
