Bureaucracy in UP shaken over SIC directive

The beauracracy in Uttar Pradesh finds itself in a spot over an order of the State Information Commission (SIC) under the Right To Information (RTI) which directed the Mayawati government to make public the income and assets of all the IAS and IPS officials within next six weeks.

''It will be a good move in order to ensure transparency in the governance and the state government is studying the modalities in this regard,'' an official spokesman told UNI here this morning.

The decision, however, has shaken a section of officers as from time to time charges were being levelled against certain bureaucrats for amassing assets disproportionate to their income.

The SIC order was passed by acting chief information commissioner Gyenendra Sharma yesterday on an application of one Brijesh Mishra, seeking details of the movable and immovable assets of nine IAS officials under RTI.

Significantly, the senior officials against whom the RTI application was moved included chief secretary Atul Kumar Gupta, secretary (Home) Mahesh Gupta and senior IAS officers Dev Dutt, Lalit Srivastava, Rajan Shukla and Chandra Prakash.

The acting chief information commissioner has asked the state appointments department to publish property details of all the officials made available to it from 2005-06 onwards within six weeks.

The applicant moved the application under the RTI when the UP government refused to give him the details sought on the assets of these officials.

The commission in his order said that under section 4 of the RTI Act, it is obligatory on the Public Information Officer to make these information public.'' When MPs, MLas, could give details of their assets, why cannot the IAS and IPS'', he observed.

In the recent past, UP had earned a bad name on the disproportionate assets case when several officials including two ex-chief secretaries-- Akhand Pratap Singh and Neera Yadav- were chargesheeted by the CBI in similar cases.

This decision of SIC will be challenged in Courts and likely to be stayed. Hon'ble Karnataka High Court has already ruled that assets and liabilities of Govt Officers cannot be made public under RTI.

लखनऊ : राज्य सूचना आयोग ने उत्तर प्रदेश सरकार को छह हफ्ते के भीतर प्रदेश मे तैनात सभी आईएएस और आईपीएस अधिकारियों की संपत्तियों का ब्यौरा सरकारी वेबसाइट पर उपलब्ध कराने के निर्देश दिए हैं। राज्य सूचना आयोग के मुख्य सूचना आयुक्त (कार्यवाहक) ज्ञानेंद्र शर्मा ने बुधवार को नियुक्ति विभाग को निर्देश दिया है कि वह साल 2005-06 और उसके बाद दिए गए आईएएस और आईपीएस अधिकारियों की संपत्ति के विवरण को सरकारी वेबसाइट पर सार्वजनिक करे।

सूचना आयोग के इस आदेश से उन अधिकारियों में बेचैनी फैल गई है, जिन पर आय से अधिक संपत्ति रखने और भ्रष्टाचार के आरोप लगे हैं। दूसरी ओर, सरकार का कहना है कि वह आयोग के आदेश पर गंभीरता से विचार कर रही है।

सूचना का अधिकार अधिनियम के तहत बृजेश मिश्र की शिकायत की सुनवाई करते हुए कि राज्य सरकार उसे नौ आईएएस अधिकारियों के खिलाफ चल रही जांच और उनकी संपत्ति का ब्यौरा उपलब्ध नहीं करा रही। शर्मा ने राज्य के सारे आईएएस और आईपीएस अधिकारियों की संपत्ति का ब्यौरा सार्वजनिक करने के आदेश दिए।

शर्मा ने कहा कि जब चुनाव लड़ते समय सांसद व विधायक अपनी संपत्ति का विवरण दे सकते है तो आईएएस, आईपीएस या अन्य अधिकारी अपनी संपत्ति का ब्यौरा क्यों नहीं दे सकते हैं। उन्होंने कहा कि कानून की धारा-4 के तहत अफसरों की संपत्ति को सार्वजनिक करना लोक प्राधिकारी के लिए बाध्यकारी है। इसे सूचना मानते हुए नियुक्ति विभाग को संपत्ति के रेकॉर्ड वेबसाइट पर सार्वजनिक कर देने के लिए उचित कदम उठाने चाहिए। आयोग ने अपने आदेश में कहा कि हाल ही में वरिष्ठ अधिकारियों की बेनामी संपत्ति का मामला जोरदार ढंग से उछला था जब दो पूर्व मुख्य सचिव अखंड प्रताप सिंह और नीरा यादव की आय से अधिक संपत्ति को लेकर केंद्रीय जांच ब्यूरो ने आरोप पत्न दाखिल किया था। मिश्र ने मुख्य सचिव अतुल कुमार गुप्ता, गृह सचिव महेश गुप्ता और वरिष्ठ अधिकारी देव दत्त, ललित श्रीवास्तव, राजन शुक्ला और चंद्र प्रकाश के बारे में जानकारी मांगी थी। एक सरकारी प्रवक्ता ने गुरुवार को बताया कि यह एक अच्छा कदम है और सरकार इस बारे में गंभीरता से विचार कर रही है।

लखनऊ। सूचना के अधिकार ने उत्तर प्रदेश में ब्यूरोक्रेट्स की नींद उड़ा दी है।

भ्रष्टाचार के आरोपी कुछ ब्यूरोक्रेट्स के बारे में जानकारी देने से हीलाहवाली कर रही उत्तर प्रदेश सरकार को आयोग ने हिदायत दी है कि वो सूबे के सारे बड़े अधिकारियों की हैसियत वेबसाइट पर मुहैया कराये। आफत में पड़े भ्रष्टाचारी अफसर अब जुट गये हैं आयोग के इस आदेश की काट तलाशने में।

दरअसल सूचना के अधिकार के तहत पिछले दिनों एक शख्स ने उत्तर प्रदेश सरकार से एक सूचना मांगी। पूछा गया कि किन-किन अफसरों के खिलाफ भ्रष्टाचार की जांच चल रही है और उनकी माली हैसियत क्या है।

प्रदेश सरकार का नियुक्ति विभाग इस सवाल से घबरा गया और उसने ये कहते हुए जानकारी देने से मना कर दिया कि किसी के खिलाफ व्यक्तिगत सूचनाएं नहीं मांगी जा सकतीं।

जो आवेदन दिया गया है उसमें मुख्यत चार सूचनाएं मांगी गयी हैं। ये सूचनाएं 11 वरिष्ठ आईएएस अधिकारियों के बारे में मांगी गयी हैं। सूचनाएं मांगी गयी थी उत्तर प्रदेश सरकार के नियुक्ति विभाग से। विभाग के पीआरओ ने ये सूचनाएं देने से इंकार किया था।

दरअसल जिन अधिकारियों के बारे में सूचनाएं मांगी गयी थीं उनमें कई इस वक्त सरकार की नाक के बाल बने हुए हैं। इन चहेते अफसरों पर कोई आफत ना आये, शायद इसीलिये सरकार ने सूचनाएं देने में हीला हवाली की। मामला पहुंचा सूचना आयोग।

आयोग ने पाया कि जिन अधिकारियों के बारे में सूचना मांगी गयी है उन्होंने कानून के मुताबिक हर 5 साल पर अपने संपत्ति का भी ब्यौरा नहीं दिया है। और इनमें से कई भ्रष्टाचार के आरोपों में घिरे हुए हैं और उनके खिलाफ सीबीआई जांच तक चल रही है।

सूचना आयोग ने प्रदेश सरकार के खिलाफ दिये गये फैसले में कहा है कि ना सिर्फ इन 11 अफसरों के बल्कि यूपी के सभी ब्यूरोक्रेट्स की संपत्ति का ब्यौरा वेबसाइट पर उपलब्ध कराया जाये। आयोग ने इसके लये छह हफ्ते का वक्त दिया है।

यूपी आईएएस एसोसियेशन के सेक्रेटरी संजय भुसरेड्डी के मुताबिक जब आईएएस की ज्वाइनिंग होती है मसूरी में, वहां हमें लिख कर देना होता है कि हमारी कितनी संपत्ति है।

हमारा तो सब ट्रांसपरेंट है। इसको शासकीय पदधारक देख सकता है। ये तो खुली किताब है जिसको पढ़ना है पढ़ ले।

if such type of decision are stayed or set aside then
RTI is helpless and so are the Honest commissioners who has got the courage to do the right things . same kind of sportsman spirit is need at every level. After some days or years the RTI will die its own death. The corruption free country will be a thing of far.
