    Salary details of spouse from Income tax department

    Dear Friends,

    I need your help in framing the RTI application for first appeal. Following is the background of the case.

    My spouse has filed for Interim Maintenance stating the she is not working and doesnt have any source of income. The court has passed the order this month to pay her a hugh amount.

    I have come to know that she is working and has filed returns for last 4 years. She has received refunds as well for few of these years.

    I filed RTI to CPIO, Income Tax of her Range. I had asked for the following information.

    1. Whether income tax has been paid for the years 2008 till 2011, by my spouse
    2. Certified copies of the assessment, if any
    3. Certified copies of the assessment orders sent to my spouse, if any
    4. Certified copies of Total gross income, net taxable income, tax paid
    5. Information about the process to initiate tax evasion petition.

    I had also mentioned in my RTI letter about the CIC decision for appeal no. CIC/LS/A/2010/001044-DS.

    The PIO has denied the information stating Section 8(j) as the reason for non disclosure.

    What I understand is, point 1, 5 cannot be denied as they donot cause unwarranted invansion of privacy.

    I need your help to frame the RTI for first appeal, which will help me get this information. How can this be shown as having larger public interest ?

    One question which arises in my mind is - has not the PIO ignored the decision by CIC in similar case ( where financial interest is affected).

    This matter will definitely go right up to the CIC.

    The best is to complete the process of first appeal by citing that CIC decision and then if the first appeal is denied go for second appeal.

    Why don't you ask you lawyer to move a petition before the court and ask the court to ask her to produce all papers in court.

    No, 1 & 5 cannot be denied under Sec 8(1)(j) of the RTI Act 2005.

    Thanks Karira for your response.

    As suggested,I am going in for the first appeal. I got one format from this site for first appeal. I was able to fill in other details except the following two sections:

    1. Prayer/relief sought for
    2. Grounds for prayer/relief sought for

    Could you please help me understand what these two sections mean? What details needs to be filled in these two sections?
