    On a court case dismissal as per rules action to taken questionnaire

    With related to the building permission, the builder, filed three suits against the Municipality. In that suit the builder categorically admitted he is ready to pay compounding fee if to get regularize the deviations made in the said buildings. The builder’s filed three suits and all the three were dismissed. Against the dismissal orders the builder filed appeals , which was also dismissed recently.

    Even though there were no interim orders from the court, the municipality instead of issuing notices to the builder for regularization of the constructions, the flat owners were forced to apply for the same in the 2008. The BPS applications are pending with the municipality as on this date.

    As the builder’s appeal suits are dismissed and he, who is wrong doer and did illegal constructions.

    On the above context, want to sent questionnaire, asking is he not liable to pay penalty and regularise, any notices will be issued or issued in the context, will the applicants be kept informed etc. Please help me in preparing the same, so that, I get the required information for the municipality.

    RTI can only help you to get information which is available on record. Please read Sec 2(f), 2(j) and 2(i) of the RTI Act: Right to Information Act 2005

    You cannot start questioning Government department using RTI for some actions they did or some actions they did not do OR force them to do something.
