I, along with 7 other, applied for information to PIO & Appeal to FAA for the same matter on single application signed by all applicants . Now we are filling appeal to cic . All the correspondence done by PIO /FAA in my name and my address. my query is, Is it compulsory to sign. by all the applicant before filing to CIC. or single person can file.(first applicant) with whom the correspondence was done.![]() |

All should sign. Donot give chance to reject/return appeal on this count.

But why 7 people filed single RTI ? You could've filed 7 different RTI 's with minor variations to exert more pressure. Infact NG0 cannot file RTI as this law is for citizens. But as advised, dont give SIC chance to reject your appeal. so all must sign. can

"..... for the same matter by single application signed by all 7..." You mean MASS PETITION ? Not allowed. I am surprised as to how the PIO and FAA accepted it . Section 6 (1) RTI Act pertains to only " A PERSON "' and not PERSONS. It is likely to be rejected or dismissed by the SIC unless of cource the SIC also belong to the same family of your PIO and FAA ![]() Last edited by colnrkurup; 10-25-2008 at 06:07 PM.. |

The application can be signed by any who is receiving the corspondence . In my one of case initially the application was signed by two person . when they apporached me I filed first and second appeal in the name of only one and no one objected to this . I think in the interest of justic the CIC will consider it and will not object. Because it has not been objected /rejected at the early stage by the PIO . |

One Person - one application - one first appeal - one second appeal / complaint .Sec 6 (1) (RTI Application):1. A person, who desires to obtain any information under this Act, shall make a request in writing or through electronic means in English or Hindi or in the .......A person - singular means one person. Sec 19 (1) (First Appeal):1. Any person who, does not receive a decision........... Any person - singular means only one person Your application signed by many applicants should have been rejected by the PIO . How did the AA even hear such a First Appeal ?If CIC is vigilant, you will be told after the waiting in the queue for 12 to 16 months that your RTI Application is not valid.Better to start afresh with one applicant per application. |

This is only slightly related to the topic of this thread. Members who are interested in legal definitions of "person", "citizen" and the "general clauses act", etc. may please read a full bench order of the CIC: http://cic.gov.in/CIC-Orders/Decision_03032008_26.pdf It is a very lengthy order but very interesting and good for increasing one's legal knowledge. |

Karira jee, hello, Thanks for your opinion on my query,pl tell me can i file a fresh application for the same matter with some additional information ? can I quote CIC decisions with application to PIO so that he cant refuse this time the disclosure of DPC proceedings. Rajesh |
