Forest land row: Affidavit seeks relief for residents
MUMBAI: In order to expedite the process of granting relief to 4.5 lakh residents having properties on forest land, a 101-page affidavit has been
filed before the Central Empowerment Committee (CEC) appointed by the apex court.
The affidavit, filed by Hill Side Residents' Association of Mulund and former BJP MP Kirit Somaiya, provides minute details on every property that has been declared to be in forest area in 2005.
According to Somaiya, the state government was dilly-dallying in providing a survey list of properties to the CEC which on November 11 had opined that the residents should be given relief in one stroke.
"I then sought permission from the committee to provide the information,'' he said. After having sought details in the past using Right to Information Act, Somaiya was able to compile the data, including year of development of various properties, survey numbers, acres of land on which a particular property was constructed, user type (residential or commercial), number of buildings on the plot, number of flats/homes and number of residents affected in each area. He also provided list of old and new city survey numbers from government records. The committee can now forward this comprehensive list to the state government and the latter can verify the facts, Somaiya said.
The affidavit states: "The structures include government buildings such as ESIS hospital, plots belonging to BARC and municipal corporation (markets). The value of 3,700 other residential complex, with a total number of 67,438 families, is more than Rs 1,000 crores. And, the total amount of housing loans taken on these properties run to the tune of Rs 2.500 crores.''
More than 15,000 flats have been purchased in Mulund, Kandivli and Malad in the past 15 years, the affidavit points out. "Residents have paid stamp duty, registration charges and plans were cleared by all local authorities, including the state government and the civic corporation. Never, prior to the high court order, were this land and survey numbers shown as Forest in land revenue records.''
Somaiya said that residents were staying here for as long as 64 years . Nearly 30 properties in Mulund and Nahur were issued stop-work notices in 2005 and the money of several middle-class investors have been stuck in the process.
"Our prayer is that 4.5 lakh residents should be provided relief in total. This land be dereserved from forest charges,'' he added.
