Can I file an application under subsection 8(b) of section 19 of R.T.I. Act 2005?

Hon'bld Sir. I usually observe that it has been common practice in the U.P.S.I.C. that I.C. does not cosider delay in furnishing information causing undue delay in providing information by PIO concern. In pursuing case proceedings I have to repeatedly travel to Lucknow without reaping fruit except next date of hearing. PIO or his authorized agent, travels on government expenses. Please made available information, how could it be filed? Whether F.A.A. is competent to consider such appeals. What will be pecentage success in such pleadings? If any precedent has been setup by some one earlier, then please made available such similar stories.

The best way is to try to sort out the issue at the FAA level itself during the first appeal hearing. Try to be personally present during first appeal and put pressure on the FAA to pass a reasoned order, after due application of mind.

The situation in the CIC and all SICs is very similar - delays of upto 3 years for the final order. By that time, there is no use of the information.
