Reasons to be provided, if such reasons are recorded on file
Case No.CIC/SS/A/2011/001497
Dated: 02.02.2012
4. On Point No. 16 the appellantsought the following information:
“Youdoes not declare awaiting list neither for Specialist/GDMO-Specialist nor for GDMO,why?”
It is the contention of therespondent that the appellant has sought reasons, which does not come withinthe definition of “information” as laid down u/s 2(f) of the RTI Act.
5. The CPIO is hereby directed toprovide requisite information, including reasons, on Point No. 16 of the RTIapplication, to the appellant, if such reasons are recorded on file, withintwo weeks of receipt of this order.

If reasons are not on record then file criminal case against the officers who passed the orders. Use Section 166 of IPC.Sponsorer

Re: Reasons to be provided, if such reasons are recorded on file
Hi all,
Although the RTI Act provides for seeking reasons of the public authority for a particular action or decision, never since the Act has come into vogue, any PIO has shared the reasons. In one of my cases Maharashtra SCI (former) had categorically told me during the hearing that he shall not pass any order on my seeking reasons of the Respondents. When I had attempted to point out the provision of law he had retorted "Aaho, kayda shikvu naka amhala. Ratra ani divas tech kartoy amhi." (Don't teach me law. I have been doing this day in and out.) So finally I had devised another method. Reasons are invariably recorded in the file notings of each file. Instead of seeking reasons, I exhort all colleagues to seek file notings. Even S/CIC does not enjoy power to deny it. Reason may not be recorded on the file but it may exist on the file notings which are in public domain. Happy information seeking.
