    Is It a Misleading Information ?

    I asked a PIO to provide me the Licence No. of the Microsoft Company for the XP Window he uses in his official computer. He replied the name and address of the shop from where the computer was purchased and did not give the said Licence No. Is it an incomplete and misleading information?

    Yes, it is misleading.

    If the computer uses genuine (non pirated) copy of windows, it always accompany certificate of authenticity issued by Microsoft.

    If the windows is purchased seperately the seperate certificate is issued.

    If the computer comes preloaded with windows the seperate certificate may not be issued but a sticker with licence number is definitely supplied.

    In my opinion, there is a very slender possibilty of pirated copy of windows being used in public authority.

    Most probably the computer was bought with preloaded windows and the licence no. sticker must have come off and lost.

    More than "incomplete and misleading" information, this is deemed denial of information:

    1. The PIO cannot ask you to approach somewhere else for information. He can either provide it to you or transfer your application under Sec 6(3).

    2. The "shop" is not a Public Authority as defined in Sec 2(h) and therefore is not bound to give you the requested information.

    3. In this case, the PIO himself is the custodian of information and therefore he has to provide it to you. The License number of the Windows XP is available on his computer and can be termed as information held "in electronic" form. This makes it fall within definition of information under Sec 2(f) ("data material held in any electronic form").

    4. Go for First Appeal.

    Is the PIO a senior level officer who can be expected to have a reasonable level of computer literacy? At least in our country even many well-educated people have very little knowledge of computer. I can't say anything for sure but it is possible that the PIO has done this out of ignorance rather than malafide intention.

    Dr.Faiyazuddin,
    This exactly is a typical example of giving misleading information You are trying to open a pindora's Box .Malpractice of purchasing 'pirated version ' computers using public money is happening at many places. This in fact is a crime. The information you had asked is too inconvenient to the PA.. The PIO is duty bound to provide it and he may not able to provide it unless he is courageous enough to give you a false licence number pertining to one of the genuine purchase else where as if that is the correct Number. Please exploit a method to find it out in case he furnish a wrong information. If the PA is smart enough he will replace it with a genuine one immediatly and furnish its licence number Otherwise he is booked depending the level of your persuation of the case.
