In response to a petition filed by journalist KG Nagalakshmi Bai, the high court on Friday directed chief minister DV Sadananda Gowda, Bangalore Development Authority (BDA), and the state government to file their objections in two weeks.
Bai, in her PIL, has alleged that Gowda had violated the law by allegedly constructing buildings in HSR Layout without necessary approvals.
She questioned the legality and constitutional validity of a site measuring 50X80ft in HSR Layout on which Gowda has constructed a five-storey building. Gowda does not have the BDA sanction for the building, Bai stated.
Bai alleged that without valid approvals from any of the civic authorities, including the BDA, the buildings were constructed.
After seeking information under the Right To Information (RTI) Act, Bai came to know of the illegal construction. She stated that the land was allotted for residential purposes but a commercial structure has been constructed instead. Bai alleged that Gowda has already exceeded in constructing more than three floors from the ground level. The fourth and fifth floors are under construction illegally.
The BDA's guidelines strictly states that amalgamation of sites is not permitted. Such illegal structures are being demolished. If one person owns more than one site, the subsequent sites will be resumed by the BDA. The case came up for hearing before the division bench headed by Justice DV Shylendra Kumar, who directed chief minister Gowda, The BDA, and the state government to file their objections in two weeks.
