Hon'ble members be informed that according to news item published in today's edition of Amar Ujala daily, under R.T.I. Act non compulsory questions will not be replied by departments of state government. Department of administrative reform of government of uttar pradesh directed all departments that under R.T.I. Act 2005 creation of information, explanation of information and redressal of grievance is not binding. Whether department of administrative reform is competent to explain the provisions of the R.T.I. Act 2005. Whether this direction of department of administrative reform is not ultravires to section 4(1)(d) of R.T.I. Act 2005. Whether department of administrative reform is encroaching the powers of U.P.S.I.C.

Hon'ble C.I.C. has passed the order that under R.T.I. Act 2005, the information which can be collected or created can not be denied. Here directive issued by department of administrative reform of government of uttar pradesh is violating the order of Hon'ble C.I.C.Sponsorer

UP govt has just clarified what is already not under RTI. Applicant cannot compel PIO to create information nor can it seek explanation [ Goa bench of HC of Bombay judgement] nor applicant can request resolution of his grievance. After getting information, he can use it for solving his grievance through other laws, including consumer protection act etc. However, in majority of cases, if govt dept has done some thing wrong, it solves applicant's problem and gets RTI application withdrawn, rather than being exposed and penalised etc.
