Compliance of CIC/SCIC Decision
Once CIC/SCIC has passed an order for penalty on CPIO and/or penal actions under the prevailing laws,(i) how CIC/SCIC ensures its compliance under the RTI Act-2005? (ii) Whether the penalty collected goes to Central/State exchequer? thnks

a. CIC/SIC orders the head to PA to deduct the penalty amount from salary of PIO (in parts).
b. Amount goes to respective authority (SIC/CIC).
c. SIC/CIC doesnt need to ensure compliance (as i have seen) as PIO/s take stay order (from Hon Court on Govt expenses) on the same.

Unfortunately there is no record of details of penalty imposed, recovered and arrears of penalty [un-recovered] at CIC/SIC level or Govt level. In large number of cases penalty is just not recovered. Appellant can pursue through RTI exact status of his case where penalty is imposed to find out if recovered or not.

Whether under section 4 of R.T.I. Act 2005 , it can not be disclosed by the C.I.C. & S.I.Cs. concerned voluntarily as follows. 1-Year-wise data of penalty imposed under section 20. 2-How much imposed penalty has been recovered? 3-If imposed penalty could not be recovered , then cause of delay? and in case of remission, detail reason how it could be possible. 4-Commission's website must be updated monthly. 5-If any public authority causes troublesome in the recovery of penalty, then he must be dealt harshly under appropriate law. Commissions must be independent bodies like Higher Courts in its function as like imposing penalties and its recovery.
