A First Appeal case is pending before the FAA-cum-Superintending Engineer, Central Circle Ludhiana, PWD since 10.10.2011. At first FAA had down-marked my Appeal to the PIO and instructed me to contact the PIO ,who in his reply claimed that all the information has already been supplied. Despite pointing out deficiencies specifically Para-wise, FAA did not bother to hold the hearing. It was only my letter warning him to go in the Commission and demanding dereliction of duty against him as he is not ready to pronounce the order u/s 19(6) of the RTI Act, FAA fixed the hearing for today.
FAA refused to take cognizance that the respondent PIO at first raised the demand of Rs.20,000/- as additional fee. On demanding detail of calculation it was reduced to Rs. 2450/- as additional fee which was fulfilled by depositing the same in cash and was acknowledged by PIO but the PIO sent 503 pages only and the PIO had deposited Rs. 1004/- only in the Govt. treasury instead of Rs. 2450/- which was deposited by the Appellant. Copy of Challan was produced by me alongwith my submission. This was clear cut case of embezzlement.
FAA advised the PIO to clear up the deficiencies pointed out by me in today's submission alongwith a covering letter by saying that "we had already provided all the documents. Once again we are sending all these" to avoid the embarrassment as the PIO again and again had claimed that all the documents have been supplied.

The matter of depositing less than what you had paid is serious !Sponsorer
Do you have the receipt for depositing cash of Rs. 2450 ?
Also file another RTI application to get the copy of the deposit slip in the treasury for Rs. 1004.
These will help strengthen your case.

I suggest that you lodge a detailed non-RTI complaint with Principal/Chief Secretary of the Dept at State Capital for enquiry and investigation. Send copy to PIO and FAA also. If no action is taken in 45 days, use RTI with office of Principal/Chief Secretary by using:

PIO should refund you excess amount collected from you. In case if you are not satisfied with adequacy or quality of information, then file second appeal.

I am waiting for the remaining information from the side of the PIO. After that I would concentrate to this case for further action.
