In several cases it is seen that, the authoraties concerned who are holding the responsibility to issue the certified copies of documents under the Act is questioning to show the reasons for collecting the copies of record. Is, furnishing of reasons manditory for obtaining the copies of required documents. Kindly, Clarify.

Under RTI Act, there is no need for a PIO to seek reason from the applicant. If any PIO were to ask you to furnish reasons for seeking such copies, challenge him to show the provision of the RTI Act under which he can seek such reasons. Also make a complaint to the Appellate Authority about this.

No need to provide any reasons. This is specifically and clearly mentioned in Sec 6(2) of the Act.

You mean that you had replied the PIO 3 months back and now planning for the first appeal ? Are you sure that you have not crossed the limitation period of one month ? Please scrutinise before sending the first appeal

Since the matter is now 3 months old, better to file a fresh RTI Application and then follow it up properly.

And in future if some one ask for reason simply say just, write a letter to me and verbal discussion is of no use. And in future take care of the time limit. Do not give extra time to PIO just fire them.

If the PIO/ FAA / IC asks the applicant to tell reason of info demand; then it is much evident that all those authorities lack Mind & respect to RTI Act. DoPT must frame such strict rules so that such guilty officers can be punished compulsorily & easily. Then only the holy RTI Act can succeed. Activists must think & act suitably.

If a PIO asks the reason for seeking information, he will be trapped under the law. Only follow up action is required.

After expiry period, can applicant file a reminder application to PIO stating that his application has not yet considered, as such supply the required documents. Kindly advise suitably.

You have already done this last time. Now please don't repeat this mistake next time.
If the PIO does not reply to your application within the time limit then you have only 30 days to file a first appeal. If you lose your time in unnecessary communication, you will miss the opportunity to file the appeal and thereafter you will have no remedy for getting the information.

In my opinion, instead of going for appeal,the applicant should file a complaint under section 18 of the Act.

Neither the PIO , nor the info commission can ask reasons for demanding the information. Reason can be written only in case where demanded info comes under RTI exepmtion section.or the info are of heavy volume causing many days engagement of PIO. or where the info demanded are of third party.
