as per news of bhaskar (dt-6/3/2012) that rajasthan university deside disclose of answer sheet deposit of Rs 580 by student.but as per rajasthan RTI act and centeral RTI act PA demand 2Rs per page thus answer sheet had 40 pages so 10RS fee and 80Rs per page charge total 90 Rs allowed. is it not read as over write on RTI.
उत्तरपुस्तिका दिखाने में कमाई का जुगाड़

जयपुर। राजस्थान विश्वविद्यालय छात्रों को उत्तरपुस्तिकाएं दिखाने के लिए प्रति उत्तरपुस्तिका 580 रूपए लेगा। सोमवार को हुई एकेडमिक काउंसिल की बैठक में यह सहमति बनी है। बैठक में इस संदर्भ में गठित प्रो.सोमदेव कमेटी की रिपोर्ट रखी गई थी, जिसे कुछ संशोधन कर स्वीकार कर लिया गया। अब 11 मार्च को होने वाली सिंडीकेट की बैठक में एकेडमिक काउंसिल की सिफारिशें रखी जाएंगी, जहां अंतिम मुहर के बाद यह मनमाना नियम लागू हो जाएगा। कुलपति प्रो.बी.एल. शर्मा की अध्यक्षता में आयोजित बैठक की सिफारिशें सिंडीकेट के समक्ष भेजी जाएंगी। वहीं, आरटीआई विशेष्ाज्ञों का कहना है कि यह देश के कानून से खिलवाड़ जैसा है।

40 पेज के 580 क्यों?
सूचना का अधिकार कानून में प्रावधान है कि सूचना के आवेदन के समय मात्र 10 रूपए लगेंगे और इसके बाद प्रति फॉटोकॉपी 2 रूपए के हिसाब से लिए जाएंगे। विश्वविद्यालय की उत्तरपुस्तिका में 40 पेज होते हैं, इस हिसाब से 80 रूपए शुल्क बनता है। एकेडमिक काउंसिल की ओर से 580 रूपए तय करना मनमाना निर्णय है।

अवलोकन का नियम कहां गया?
सूचना का अधिकार कानून के तहत यह भी प्रावधान है कि आवेदक को संबंधित दस्तावेज का अवलोकन कराया जाए। इसके लिए एक घंटे तक नि:शुल्क अवलोकन का प्रावधान है और इसके बाद हर 15 मिनट के 5 रूपए शुल्क लगता है। विवि. की ओर से बनाए जा रहे नियम में उत्तर पुस्तिका अवलोकन की कोई व्यवस्था नहीं है।

In view of your friend, transparency act was passed on 15th june 2005ie more than six and half years passed but no evaluated copy was shown to students because university could not decide in these six and half years that how much be charged from students. In view of your friend, under section 28 a competent authority has power to make rules. Subsection1-The competent authority may, by notification in official gazette, make rules to carry out the provisions of the act. Subsection2-In particular, and without prejudice to the generality of foregoing power, such rules may provide for all or any of following matters. (i)cost of materials to be disseminated under section 4(4). (ii)fee payable under section 6(1). (iii)fee payable under section 7(1). And others which is to be required. Here competent authority means speaker house of people, legislative assembly of state etc , Chairman in case of council of state. Chief justice of India in the case of S.C.I. Chief Justice of High Court in case of Highcourt. President or Governor as the case may be, in the case of other authorities established or constituted by or under the constitution. Administrator appointed under article 239 of constitution. Here this question arises that whether Vice Chancellor or committee formed by Vice Chancellor is competent to make rules regarding the processing of R.T.I. Communique. Whether any competent authority has power to formulate laws which may cause the demolition of original structure of transparency act. Here mens rea is ipsofacto obvious. Actus non facit reum nici mens citria ie act itself does not make a man guilty unless he intends so.

after over write on the RTI act by Rajasthan university increasing fee of discloser of answer sheets now rajsthan technical university also follow them and decide just fee for disclosing of answer sheet deposit Rs 1000.when central and state RTI act made by parliyament / state assembly and fee is also mentioned in that act then how RU & RTU decide too much fee for information ? is any rule allow them for it ? is this action discourage to use of RTI act
कोटा.राजस्थान टेक्निकल यूनिवर्सिटी से जुड़े छात्रों को परीक्षा के बाद अपनी कॉपियां देखने की सुविधा मिलेगी । राज्य सरकार से अनुमति मिलने के बाद कुलपति प्रो.आरपी यादव ने सोमवार को इसके आदेश जारी कर दिए। उन्होंने बताया कि सुप्रीम कोर्ट ने गत दिनों निर्देश दिए थे कि सभी शिक्षा संस्थानों में परीक्षार्थियों को परीक्षा के बाद अपनी उत्तरपुस्तिकाएं देखने की छूट दी जाए।

उसी की पालना में यह छूट दी गई है। आरटीयू की सत्र 2011-12 की दिसंबर-जनवरी,2012 में हुई बीटेक, एमबीए, एमसीए, बीएचएमसीटी व एमटेक परीक्षाओं के रिजल्ट घोषित होने के 15 दिन में छात्र कॉपी देखने के लिए आवेदन कर सकते हैं। इसके लिए आरटीयू वेबसाइट पर ऑनलाइन आवेदन फॉरमेट भरकर डीडी या चालान से 1 हजार रुपए प्रति कॉपी शुल्क जमा कराना होगा।उसके बाद विवि द्वारा दी गई तारीख पर कॉपी देख सकेंगे। कॉपी देखने के लिए छात्र को 10 मिनट का समय दिया जाएगा।


परीक्षा नियंत्रक डॉ.अनिल के. माथुर ने बताया कि दिसंबर-जनवरी,12 में हुई ओड सेमेस्टर (पहले, तीसरे, पांचवे) की परीक्षाओं के नतीजे घोषित होते ही छात्रों को यह सुविधा सशुल्क मिल सकेगी। इससे पहले के वर्षो की कॉपियां देखने के लिए सूचना के अधिकार के तहत आवेदन करने वाले छात्रों को निर्धारित प्रक्रिया पूरी होने पर ही कॉपी दिखाई जा सकेगी।

ऐसे करें आवेदन

आरटीयू वेबसाइट पर ऑनलाइन आवेदन फॉरमेट भरकर डीडी या चालान से 1 हजार रुपए प्रति कॉपी शुल्क जमा कराने के बाद विवि द्वारा दी गई तारीख पर कॉपी देख सकेंगे। कॉपी देखने के लिए छात्र को 10 मिनट का समय दिया जाएगा। परीक्षार्थी मूल्यांकन से संतुष्ट न होने पर रिवैल्यूएशन के लिए आवेदन कर सकेंगे। नए नियमों के अनुसार, अब मुख्य परीक्षा के बाद दो के स्थान पर एक बार ही रिवेल कराया जा सकेगा।


मूल्यांकन सिस्टम पारदर्शी रहेगा

आरटीयू ने राज्य में सबसे पहले छात्रों को सत्र 2011-12 से कॉपियां दिखाने की व्यवस्था लागू की है। रिजल्ट के तुरंत बाद कॉपी देखकर छात्र रिवेल के बारे में निर्णय कर सकेंगे। इससे परीक्षा व मूल्यांकन सिस्टम पारदर्शी रहेगा।

In both cases you must file a separate Complaint with the Rajasthan State Information Commission under Sec 18(1)(d) of the RTI act.
The Rajasthan University or the RTU are not competent authorities (sec 28) to fix the fees. Nor are they the appropriate government (sec 27).
Both are PAs under the State Government and must therefore follow the State RTI Rules for application fees and additional fees.
