    First appeal or Complaint

    I made an RTI application before a Public Authority in Kolkata. As the RTI applicant was turned down on the grounds of voluminous/sensitive information, I made a first appeal to the FAA. While making the first appeal, i enclosed copies of similar information/documents provided to me by another PA from Mumbai on the basis of orders passed by CIC. However, while disposing the appeal the FAA made the following remarks which I quote them here:

    Quote "It is noted that the PIO had accepted your RTI application and responded promptly within the RTI deadline under the provisions of RTI Act 2005
    2.The grounds put up by the Appellant for the appeal have been examined in line with the RTI application and the pIO's order thereto. It has been observed that the PIO has corrected applied the provisions and restrictions contained in RTI Act 2005, keeping in view the voluminous and sensitive details sought under the RTI application.
    3.It is also observed that the RTI Appellant has enclosed the copoy of documents collected from other competitors in the industry. Thus the confidential and restricted business details/sensitive and strategic information has every likelihood to fall in the wrong hands for the misuse by others. The PIO has taken required steps for providing the details as sosught under the available proisions of RTI ACT 2005 to serve the public interests at large." Unquote


    First of all no hearing was conducted and the remarks under paragraph 3 are sweeping in nature. The copies of documents and similar information were attached with the first appeal to show that similar information has been provided by another PA under orders of Central Information Commission.

    Can I make a complaint to CIC for the sweeping remarks made by FAA as I feel that the copies of documents were attached with the first appeal to show that the denial of similar information by PIO is wrong and erroneous. I also would like to know that the documents and information received from another PA cannot be used as reference. Please advise me.

    Since you have made a first appeal you can avail the option of Second Appeal..


    "voluminous/sensitive information" is NOT the criteria set for denial of information...

    Information can only be denied U/S 8 or 9 of RTI act 2005 pl go through section 8 & 9 of RTI act.
