Rti reveals wb cmo official doc missing My RTI to CMO, WEST BENGAL on October 14 2011 was replied on Feb 9th 2012, ofcourse after FAA(16th Dec 2011) followed by Complaint letter to WBIC on Feb 6th 2012, that CMO need the RTI Base Letter (My PETITION dtd June 29th 2010, to CMO to refer my 3 time repeat burglary to CBI)
Pls refer all attachments & guide me the best course of action from RTI perspective aswellas from 'Missing Govt. Record.

Best is to supply him a copy of the earlier RTI application (if it is concise) and see what happens.Sponsorer
If he does not provide the information or you are still not satisfied, you always have the chance for another first appeal and then second appeal.

Thanks for your reply.
My point is RTI is just a tool to evoke transparency in government/civil deliverables that the constitution entitles to its citizen. Its scope may be limited by (bad)virtue of the 'people' who enact it with IN-BUILT lapses.
I am going out of the ambit of RTI just to come back so soon with crisp links.
I, as a citizen of india gave a petition to the CM of West Bengal on June 29 2010. (a state of India Union) and the CMO office says that they donot have the complaint/petition itself. This is called 'double victimisation'. I gave petition to CM on the ground that there is foul-play in police investigation (PS abetted a crime in my house). If the CMO itself does not take the responsibility of ATLEAST having a citizen's petition in a proper care, leave alone the SO CALLED ATR on such petition.
In my petition I asked CM the permission for CBI inqury by stating several lapses and wrongly focused/directed investigatioin by Kolkata Police. If CM does not take care of a complaint against its Home department's lapses or accusations, it only goes to tel that 'I too least bothered about Law and Order and subsequent Injustice in the administration'
THIS IS AGAINST THE SPIRIT OF RTI ACT, to the extent that 1. CMO also donot do any justice to its mission statement, if atall west bengal has one and 2. CMO donot give care/value to a citizen's petition, in both the cases the administration is against 'TRANSPARENCY' which is the essence of RTI.
Please comment, if they donot have the petition itself and ask me to supply if afresh, i.e., submit my copy of the petition, it only means that I cannot expect that some 'INFORMATION' existed till date and the base letter of my RTI itself takes birth at the time I submit my copy of petition, because RTI deals only with 'PRE-EXISTING' information.
Now I again go out of RTi and I want RTI in fixing the responsibility of missing/disappearing government records.
Pls comment and help.

IC can direct the Public Authority to get a police complaint registered in respect of missing records . Police may investigate the matter then or you may file a private criminal complaint with the Magistrate
