If the PIO decides to supply you the inormation he will intimate you the cost of the information plus cost of postages. Remit those expenses and you will get the information by registered post. But it is not so simple. The PIO must first decide to give you the information. |

Mangesh, After you have applied for information to the PIO, your work as an applicant ends. It is the responsibility of the PIO to provide you information. If you do not get it within 30 days (irrespective of which method PIO chooses to send you information) , all you have to do is file First Appeal. There are some States which have specified forms for asking information under RTI Act and in a few of them there is a column asking something to the effect: How you require information: in person/ post/ registered post etc. Check the RTI Rules for your State (Maharashtra) available in the Guide segment of the forum. |

The responsibility to prove that you have competently filed an application seeking information to the PIO is yours. The responsibility to prove that he has furnished you reply or provided you the information is that of the PIO. It is upto the PIO to consider as to how can he establish that he has replied you or provided you the information within the prescribed period. It is upto him to decide whether to use ordinary post or registered post or speed post or special messenger. Normally you have no choice. |

In a case decided by CIC on 31/12/08 (Case no.CIC/OK/C/2008/00809) upon repeated submission by appellants before CIC about non receipt of reply sent by PIO, CIC directed PIO to ensure that all replies to RTI applications henceforth are sent by Speed Post / Registered Post. |
