Dear Sir,
In reference to letters referred above, please provide following information under RTI
1 As per letter under reference at s.no.1, age of superannuation has been mentioned as 62 years. Under 6th CPC age of retirement for teachers is 65. Further a. University vide notification IG/TA/2/862/08/297 dt 28th Jan.2009 notified that service conditions of Academics and Asst. Professor, Associate Professors and Professors will be the same. b. Earlier circular TA/2/15/90/396 dt 7/6/1994 informs that BOM has approved that The age of retirement of Teachers and other Academics will be the same. c. BOM at its 98th meeting held on 14/01/2009 again reiterated its earlier stand and decided that “ the Asst. Regional Director(ARD), Regional Director(RD) and Senior Regional Director in the Regional services Division(RSD) and corresponding levels of Academics/other Academics will be governed by the same Recruitment rules, Career Advancement scheme and service conditions as those of Asst. Professor, Associate Professors and Professors. d. How the advantage of 65 years has been given to a section only. Please provide copy of relevant order.
Please furnish the prevailing rule under which superannuation age is fixed at 62 years for academics? If this is approved by MHRD?
2. As per procedure the PF subscription should be stopped 3 months prior to superannuation. When was RC Bangalore informed to stop PF subscription in my Case? If this information is not required to be sent from ACD, how Regional Centre is supposed to initiate the action? Rule position in this regard is requested. (copy of excerpt from Masters manual for DDO & Head of office enclosed)
3. When was my application for final withdrawal of PF in prescribed format received in HQ, which was sent by me vide letter no 4541 dt 23/8/2011?
4. When was the Pf payment released by the University, which was received by me on 14/01/2012 vide letter dt 11/01/2012 with cheque dt 10/01/2012?
5. For the delay beyond one month from the receipt of application on prescribed format, why the interest has not been paid as per rules? Presently the interest has been allowed up to May’11. It is customary to release the PF on day of superannuation, then the contention is valid but if it is not released on the date of superannuation under which rule the interest is regulated up to May ’11? (see rule quoted under point 6.)
6. For the reply vide letter at s.no.2, who is responsible for misinterpreting the rules and denying the legitimate interest due?
As per rules for final payment of accumulation in PF (Swamy Handbook 2012, pp 244-245)
“ Interest:- if the payment cannot be made within one month after retirement or after the date of receipt of application in the prescribed format, whichever is later , due to administrative reasons, interest is payable up to six months for the period beyond one month. Interest can be allowed up to one year by the head of Accounts Office and beyond that by the Superior to Head of accounts Office.”
As per Rule11 (4), (1) GID (2) below rule 34, GPF rules @ Rule12 and note there under CPF rules
7. As per financial code University has provision of imposing penal interest on recoveries. What are the provisions, if individual’s payment is delayed at the University?
8. In reference to my request letter at s.no.3 (copy enclosed), regarding pay fixation on promotion, I was informed that the case has been referred to MHRD, what is the status? Since 2004 it is almost EIGHT years. Copy of latest communication to MHRD in this regard may please be provided.
The necessary fee for RTI application Rs 10/- and document charges @2/- per document total Rs 50/ - demand draft no 016612 drawn on HDFC Bank dated 10/04/2012 is enclosed for necessary action
