Appeal not answered back
Their is no reply for an rti sent by me on 15_2_12 to first appallant officer. I asked him to provide the required information denied by pio.
1 Now whom should I inform about the same.is it SIC
2 is it a deemed refusal.
3 how to file complaint and impose penalty.
4 how should I proceed with rti so that I get necessary info.
Please advice.

First Appeal date: 15-2-2012Sponsorer
Last date for FAA to pass order: 15-3-2012 or at the most 30-3-2012
Last date for filing second appeal: 15-6-2012
1. File a second appeal with the SIC or CIC - as the case maybe depending on under which government the PA falls under
2. This is termed as "deemed refusal" of information by PIO.
3. In your second appeal, you can pray for penalty on PIO as per Sec 20 of the RTI Act.
Also pray that the SIC/CIC directs the PIO to provide you teh complete and correct information that you applied for.

To strengthen your Second Appeal, its better to send a reminder to FAA thru Regd. Post and you may wait for another week. Then you file a appealing Second Appeal, which might tempt the IC to use sec 20.
In the Appeal you may ask for the following..
Prayer:
1) Issue a show casue notice to PIO as to why a Penalty of @ 250 per day ( max 25000 ) should not be imposed on him
2) Direct the FAA to submit his reasons in-writing for not performing his duties, inspite of several reminders.
3) [ OPTIONAL, if you are particular about receiving information] - Information at FREE OF COST
Grounds for Appeal:
1) PIO did not respond within time limits specified by RTI Act, which attracts penalty u/s 20(1) RTI Act 2005
2) FAA did not decide on Appeal, inspite of several reminders
3) Sec 7(6) suggests that Information shall be provided Free of Cost when the PA fails to adhere to time limits.
