Petitioner pleaded with the Court that the appointment of Himachal Pradesh SIC was not in accordance with Sec 15 of the RTI Act. He contended that the SIS should include one CIC and at least one IC.
The State felt that it can appoint maximum of 10 IC's but this number can be zero also.
Himachal Pradesh High Court ruled that the SIC should have one CIC and at least one IC but refused to stop the State CIC from performing his duties saying that this would lead to chaos.
