Information regarding disciplinary proceedings cannot be denied under Sec 8(1)(e), (g) or (j)

The Delhi HC has upheld an order of the CIC wherein it ordered disclosure of information related to disciplinary proceedings. This was initially denied under Sec 8(1)(e), (g) and (j).

The Court ruled that 8(1)(e) was not applicable because file notings were part of "information" and that there was no fiduciary relationship between a Governments servant and the Government itself.

Similarly 8(1)(g) could not be invoked on the mere basis of "apprehension" without any firm basis. Disciplinary proceedings were not "personal" and file notings made by officers are definitely public activity and have larger public interest.
