    Pio office refused to accept the copy of the 2nd appeal of cic

    Dear Friends,

    1. I have sent RTI on 31-5-2011 to PIO and same was replied after 140 days for that I have filed First appeal to F A A and no reply received from FAA.
    2. I filed my 2nd appeal to CIC on 9-04-2012
    3. In another RTI application on 19-01-2012 to PIO. PIO returned my application and refused to reply my application.
    4. I appeal to FAA and he also endorsed the reason of PIO.
    5. I filed my second appeal to CIC for my RTI dated 31-5-2011 & 19-01-2012 separately. And received diary number.

    6. I have sent copy of 2nd appeal (CIC) to FAA(Separately) by speed post and delivered to addressee.
    7. I have sent one copy to head office of the Dept by speed post same has been delivered.
    8. I have sent 2 (separate) Copy of 2nd Appeal (CIC) to PIO by speed post and after tracking it was found that same has been delivered to PIO office on 23-04-2012 I have a print out of the track
    record.
    9. Now today (30-04-2012) I have received my both envelope back with the remarks that “NOT KNOWN” bearing date 25-04-2012.

    I have mentioned the address of the PIO correctly from which I have received my reply from PIO.


    Kindly guide me:-

    1. Should I sent both the enveloped to the CPIO Legal at H.O Address and
    copy to CIC?

    2. Should I asked the Postal Authority why they accept the letter from the
    office of the addressee after once it was delivered.?
    3. Should I inform the CIC? Along with copy of the both the a envelop?

    Hon'ble member. You respected member may submit supplementary to appeal filed under subsection 3 of section 19 of R.T.I. Act 2005 before information commission. In this supplementary, you respected member may explain the fact that how PIO deliberately denied communication under R.T.I. Act 2005. Ipsofacto obvious that postal department has done nothing wrong, only performed its obligatory duty.

    To file a second appeal, you have to provide "Proof of dispatch" to the PIO and FAA and not the "Proof of Delivery". Your duty ends after dispatching them. At the time of hearing you can produce all those letter and proof before the IC to strong your case.

    CIC can not withheld your hearing just because the copy was not delivered. In any case the CIC will be sending those copies along with notice of hearing.
