Location of inspection changed since too far away from appellants place of residence
In a rare gesture, CIC has allowed the inspection of certain documents by the appellant (resident of Dimapur) in Kolkata, since the travel to the location of documents (Raiganj, Bihar) will involve huge expenditure and logistics on the part of the appellant.
This Commission has consistently held in several of its decisions
that the information seeker is entitled to take inspection of documents in such like
matters but for personal information submitted by third party. The appellant is
based at Dimapur and the documents have been kept at Raiganj, (Bihar). Needless
to say, inspection of these documents at Raiganj by the appellant would involve
huge expenditure on her part, apart from causing her logistical problems. In the
fact and circumstances of the case, it is ordered that the appellant or her
representative may be given inspection of the entire records in BPCL office at
Kolkata on a mutually convenient date and time. The appellant will be entitled to
take copies of the documents but for documents which contain personal
information viz Bank statements and PAN card number etc.
