Need Help: Original Property documents verification from SBI

Hi

I'm purchasing a property mortgaged to SBI. I'm taking loan from HDFC and HDFC asked for the acknowledgement from SBI about the original documents with them.

When I contacted SBI, they initially said that the documents are missing but after some rounds they have given me the acknowledgement for the same.

I'm suspicious now and wanted to verify this myself before asking HDFC to disperse the loan amount. HDFC will not disperse the complete loan amount till they get the originals from SBI and I will be in deep trouble if SBI later says that they don’t have the originals.

SBI is not helping me in this regard. They don’t allow me to check the papers. can I file a RTI query for the same. I'm already having a NOC from SBI that I can purchase the property after paying the loan amount.

Since this will amount to accessing record of customer of the bank, RTI will be rejected u/s 8.1.e and j. Normally officer of the bank which takes over the property as security visits and verifies file with existing bank to ensure that documents are in order.

In few cases the bank whose account is being closed by transfer from other bank, tries to persuade the buyer to avail loan with that bank only [ in your case SBI] and hence create problems so that you also avail housing loan from them only and not HDFC.

In case branch head is not cooperating, you may file complaint with Regional Office or Local Head Office by visiting website of SBI.

Thanks jps50 for your valuable input. I've instructed HDFC to verify the documents by sending legal teams. I'm still to hear back from them. Even if I'm being persuaded to take a loan from SBI, I'd like to verify the documents.

can the seller himself file an RTI for the same ?

Yes, he can file RTI with the same branch of SBI, since all branch heads are ACPIOs. He can get certified copy of entire file under RTI. Please refer:
