RTI inspection , refusal of records to my RTI application the PIO responded with reply wheras i have sought the access to the file and records. The appeal to FAA was made and FAA directed the PIO to furnish the record.
I am currently stationed in Oman on a consultancy assignement after my retirement. After due notice of one month and on the confirmation of PIO for making the record available for inspection, i have visited chennai to inspect the records. To my surprise the PIO could not produce the records for which the informations were sought and the file produced are not tagged - numbered and in loose sheets and these sheets are not related to the information sought.
An officer posted to provide files, have refused to disclose the files without consulting his lawyers and i had to return back after spending considerable amount in way of travel.
i have already lodged the complaint with the CIC for non cooperation by the officer with the malafide intention to deny the information and for compensation on the loss incurred and to penalise the PIO for having not furnished the information over 30 days. i am also contemplating to file a case in consumer forum for deficiency of service.
i solict the view of the readers on this tag.

You can make an additional prayer to CIC also, seeking compensation for the detriments suffered

The relevant portion of the judgement of the supreme court in Miss Radha Bai Vs THE UNION TERRITORY OF PONDICHERRYREPRESENTED BY ITS CHIEF Secretary & Ors decided on 20.04.1995 (Equivalent citations: 1995 AIR 1476, 1995 SCC (4) 141) which is reproduced herein below will be useful for you while arguing before the commission in connection with your complaint -
" A responsible statutory authority or administration, owes a duty to the public, to discharge its functions reasonably, honestly and bonafide, without driving the aggrieved persons from pillar to post, and should there be any non-excusable lapse on this score, the concerned authority or administration, should be held responsible for the loss or damage accruing thereby to the aggrieved persons."
