How to pinpoint the main culprit?
Majority of PAs donot display names of PIOs instead they display designations of PIOs. Eventually applications are also addressed to PIO naming his /her designations.
In some of my RTI second appeals, PIO, who had received my RTI application and was on that seat for more than 2 months and still failed to give any response whatsoever as per section 7(1), therefore that PIO was personally responsible for deemed refusal.
However when appeal was heard, new person who replaced him was pleading ignorance saying that he has just joined. I requested SIC to call the defaulter PIO for hearing but SIC declined and asked new PIO to provide available information. In this process defaulter PIO got scot free, I suffered unnecessary, avaidable delay and process of appeal as applicant.
I am sure many others too would be facing such problem. How to counter this?

These days most ICs refuse to take action on the errant PIOs. They give stress on the information. The former PIO, who ignored the RTI application, must have been punished. If watchdog of transparency ACT declines to enforce the ACT by letter and spirit, then what can be said for the FAAs? If affordable, the order should be challenged at HC.I requested SIC to call the defaulter PIO for hearing but SIC declined and asked new PIO to provide available information

In another case, which came for second appeal hearing after 1 year now (in this case no action whatsoever was taken by PIO on my first RTI application and even first appeal was decided by his subordinate officer). This PIO who was in seat till now (recently got transferred) his successor PIO also sent his junior for hearing.
I brought to the attention of SIC that PIO who handled my application should be called as its his onus to prove that denial was genuine u/s 19(5). However SIC didnot agree and have called current PIO for next hearing which falls in FEB 2013......

I think you have a very good case for Writ Petition before Hon'ble High Court .
