APPEAL AGAINST SEC 11(1) and SEC 7(9)-reg
Dear and Respected Members,
Please find the attachments. Recently I have requested a PIO(The PIO is a Labour Inspector)to furnish certain information regarding the following
(1)No/Name of Multi Specialty Hospitals in his jurisdiction and the Inspection details
(2)No/Name of Super/Hyper/Departmental Stores in his jurisdiction and Inspection details
(3)No/Name of the Hospital canteens in his jurisdiction and Inspection details.
(4)Other related documents of the S.No: 1 to 3 stated above.
The PIO in his reply has simply used the Section11(1) and Section 7(9) of the RTI ACT 2005 and refused to furnish the information sought by me. No doubt I have lot of time to go for an appeal with the FAA.
Before going for appeal with the FAA, I would like to consult our forum members and seek their help
in this regard. Please help me.

In fact there was no need to invoke section 11 by PIO.

Both Sec 11 and Sec 7(9) cannot be used for denial.
Sec 11 is only a procedural section to be followed by the PIO in case the information sought relates to a third party or has been submitted by a third party in "confidence". In any case, the information you asked for has been generated by the department and belongs to the department.
Sec 7(9) allows the PIO to provide the information in another form than in the form that has been sought.
File a first appeal within 30 days of the PIOs reply.
