Next step if pio does not reply
OUR APARTMENT ASSOCIATION SECRETARY WROTE LETTER TO Public Information Officer,
Directorate of Town and Country Planning,CHENNAI SEEKING INFORMATION REGARDING APPROVED LAYOUT,PLANS,CONDITIONS LAID DOWN BY AUTHORITIES TO THE BUILDER AND COPIES OF DOCUMENTS. HE HAS WRITTEN THE FOLLOWING ALSO IN HIS LETTER TO PIO, DTCP AS PER THE GUIDANCE OF RTI.ORG.
I have remitted the requisite fee towards seeking information under RTI Act as court fee stamp for Rs.10/-.
As the above details are very urgently needed, I request that the same may be furnished to me at the earliest.
In case the requested Information is held by another public authority, I request the PIO to transfer the application or part of it within five days and immediately inform me about such transfer.
In case there are further fee required to provide the requested information, I request the PIO to inform me of the additional fee amount along with the calculations made to arrive at the amount.
In case of rejection of my application, I kindly request you to provide the reason for such rejection and not just quote a section of RTI. Also I request you to provide the details of Appellate Authority.
We have not received any reply though 35 days elapsed.
Now I want to know the next step.
If we have to write to the Appellate Authority, should we write similar application or a letter informing the lack of response from the PIO along with copy of the letter already written to PIO.
Should we pay the fee again on this letter also.This is our first experience with RTI
Please clarify

No information within the prescribed time limit of 30 days is termed as "deemed denial" of information.Sponsorer
File a first appeal for deemed denial of information.

Use it after suitably modifying it for your case.
First appeal has to be filed within 60 days of the date of your RTI application (since you did not get any response from the PIO)

Thank you for your prompt guidance. We received reply from PIO Director of Town and Country Planning Chennai today. The office of PIO has received our application under RTI ON 30/05/2012. He has forwarded the application under RTI to their Regional office at Madurai with instruction to provide the information sought for in our application.Our application has been sent to regional office on 08/06/2012. Now we seek a clarification. Since the time limit of 35 days has been exceeded ,can we ask them to provide copies of documents free of charges? Kindly advise us.

fie first appeal with in sixty days for deemed denial of information's against your application. send all the copies to FAA like your application/ PIO details / fee details/ postal receipt/postal acknowledgement etc.,along with your appeal.

Yes, you can demand information free of charge.
Send a letter to the new PIO (in Madurai) and point out the dates clearly and inform him that as per Sec 7(6) of the RTI Act 2005 the information should be provided free to you.
