    Wrong Information given under RTI

    Hi,

    I would like to know what are the provisions regarding totally wrong and false information provided by the PIO under RTI. What action and under which section of the RTI Act 2005 or IPC, the matter can be pursued further?

    If the PIO provides you incorrect or misleading information, the best course is to file first appeal against the decision of the PIO. It has to be filed within 30 days of receiving PIOs reply.

    You will have to clearly show how the information is incorrect or misleading.

    If you can prove that the PIO intentionally or malafidely provided you incorrect and misleading information, then, when you file a second appeal (after first appeal process is over) or complaint to the SIC / CIC and demand a penalty of Rs 25,000 on the PIO.

    Only SIC / CIC has powers to impose penalty. The first appellate authority cannot impose any penalty.

    Thanks Karira. This seems to be very ridiculous of the RTI Act. It could take months and Years for the disposal of the appeals. The public authority's can provide false and misleading information intentionally to subvert the queries and onus lies on the applicant to prove it. By the time the appeal is heard, the PIO will be transferred and nothing effective would come out of it.
