Petition filed to The Governor of Punjab for removal of Information Commsssioner from his post being incompetent

Recently appointed as State Information Commissioner, Punjab was previously a full time Journalist and still he is an active journalist. While deciding my one appeal, according to me he acted shear against the bases of law as per RTI Act .

Even inspite of various emails with law points and strong arguments and also after a written request to reopen the matter, IC paid deaf ear to it, which is not only unlawful as well as against the set principal of natural Justice and procedures as laid in Indian Judicial System.

So the only remedy left was to file a petition for his removal.

I will fight against the injustice till my last

1. Please read the conditions for removal of a IC inSec 17(3):

a.	is adjudged an insolvent; or

b.	has been convicted of an offence which, in the opinion of the Governor, involves moral turpitude; or

c.	engages during his term of office in any paid employment outside the duties of his office; or

d.	is, in the opinion of the Governor, unfit to continue in office by reason of infirmity of mind or body; or

e.	has acquired such financial or other interest as is likely to affect prejudicially his functions as the State Chief Information Commissioner or a State Information Commissioner.

a, b, and e are obviously not applicable in your case.
Can you prove d ?
Or do you have any evidence of c?

2. Our member smbhappy from Punjab had posted somewhere on the forum that the Governor of Punjab has delegated his powers under Sec 17 to a "committee" of Information Commissioners. (Sorry cannot locate the thread right now - just search for it or PM smbhappy). So your compalint will ultimately land up with a committee of "brother/sister commissioners".

Dear Mr. Karira,

Issue is not that I am sure to get IC sacked; Let it go on, he has power to do our bad in ADJUDICATION. Third, if I start it, people will be encouraged to fight against injustice, fighting is my goal reward is in hands of Almighty. You will appreciate, that this is what we are empowered to do by law and that we do. I agree that venom-less bite will not kill a man. But biting itself is very painful and do hurt ego of a person, who understand that he is mighty and other are week buy are still not showing total subjugation. The issue further is, if the Governor sends it to so called collegiums, I will adopt the writ recourse to deal with that sending my application to collegiums and formation of collegiums is all unlawful. Let us see what the High Court finds out. It is a continuous battle and I will fight till my last breath.

I will sure like to have your guidance, as I am going now to each and every so called temples of Justice to expose their truths and to tell them that people do exist who want to die for results, it may go delayed as long as the corrupt wish but we will not succumb.

Let us all make mass efforts. File mass true petitions at every this and that injustice and tell them that we will not bear the injustice even an inch and revert back with same vigour and with as much as the strength as God has given us , like a squirrel bringing sand particles to assist in making in Ram Ji’s Bridge to Lanka.
