    Thumbs up CIC ordered Rs 5000 compensation

    my friend sh. Dilip submitted RTI application to Staff Selection commission seeking information as to SSC graduate level exam 2004 as he is sufferer being selected by ssc securing higher rank is drawing less than about 10000 pay in ICAR against his lower ranker posted in same department. SSC provided incomplete information on 2 points and after filing I st appleal on 2 points rest 9 points replies were not given. IInd appeal was made in CIC. on 6-6-12 he could not appear as his RTI application & other documents were misplaced due to the date of hearing came after about one year. Nevertheless, chief Information commissioner, CIC take serious view against SSC as after one and half year they could not provide information to sufferer Govt. employee hence CIC ordered SSC to give Rs. 5000/- to Sh. Dilip kumar, applicant and the information be provided within 15 days at free of cost.

    Satymev Jayte, CIC has established the ruling of the truth. Up with justice down with injustice. I convey my salute to CIC.

    Hon'ble members. If this is really a true story then this story must be updated on the website of CIC which will really inspirate the information seekers. Hon'ble member your friend will be more glad if you will make available the cheque no. and others material like appeal no.,date of disposal of appeal or status of appeal etc. You are heartiest congratulation on this achievement. This is my humble request to Hon'ble Karira Sir to be instrumental in providing authentic information to forum.

    Mr Prabhudeva is lucky by the grace of Prabhu that his appeal didnot fall in Raj SIC. If you see online decisions on Raj SIC website, you will find majority chunk where in appellant's absence in II appeal hearing being presumed as he has nothing to say and he has been given information by PIO. SIC donot consider if appellant had valid grounds while filing appeal.

    In some cases, SIC, Raj acknowledges and notes in its decision clearly that there was a notable delay in providing information, but SPIO is left off by simply giving oral warning (dont ask which part of act empowers SIC for issuing such warning).........see the attachment.....

    Hon'ble member. Your friend submitted an appeal under subsection 3 of section 19 of R.T.I. Act 2005. This appeal is being processed by U.P.S.I.C. as complaint no. 169 of year 2009 which has been fixed for next hearing on 1 august 2012. In this respect, I submitted an application under subsection 8(b) of section 19 of transparency act with annexures addressed to Hon'ble Prime Minister of India as implementation of R.T.I. Act 2005 is monitored by ministry of personnel , with request to direct appropriate authority to consider the application in accordance with the law. PMO forwarded the matter to Government of Uttar Pradesh through chief secretary of state. State government instead of forwarding the application to U.P.S.I.C. , forwarded the application to PIO to process under aforesaid subsection because inefficient officers of state government were not apprised with the fact that under aforesaid subsection processing of application is made by information commission only or they deliberately did it to shield PIO. In state of uttar pradesh , there is mockery of the provisions of R.T.I. Act 2005. More ridiculous is that still your friend is awaiting information and clever PIO is in search of opportunity that your friend may be absent from proceeding and case may be disposed by the commission on the same day.

    File NO. CIC/SM/A/2011/001822 date of hearing 6th June, 2012, date of decision 6th June, 2012, Name of Applicant Sh. Dilip Kumar, Asstt. works Section, IARI, New Delhi. CPIO Staff selection commission. the information and the cheque of Rs. 5000/- were to be provided to Dilip within 15 days the same have not been received yet.
