    Notice issued u/s 18(2) of RTI Act by Administrator,HUDA Gurgaon.whether legal

    Sir,the self styled functionnig of the administrator HUDA Gurgaon is very confusing.At one time he is 1st appellate authority despite order of FCTCP dated 14.9.2011,At one time he issued notices to initiate enquiry U/s18(2) of RTI Act.at one time he transferred the appeal to Estate officer who is SPIO in the same case.Please solve my problem.I am totally confused.

    Jurisdiction of AA under RTI Act is limited to s.19(1) . Beyond that it is not sustained in eye of law .

    But, the Administrator, by virtue of being HOD , can initiate any required Inquiry or action as per by-laws of the Authority / Govt. which are not covered by RTI procedure / rules .

    The FAA is required to decide the matter within 30 days or at the most 45 days from the date of submission of First Appeal. If not, file second appeal within stipulated time.
