    Pio not responding

    Dear Members,

    Very recently I have requested for some information with a PIO. The PIO in turn has sent my RTI application to his several subordinates directing them to furnish the information to the RTI Applicant.
    The PIO has not informed about this matter to the RTI Applicant till date.
    In the mean while, some of the subordinates of the said PIO’s have denied the information directly to the RTI applicant under Section 7(9) of RTI Act 2005 with intimation to the PIO. The PIO has not replied to the RTI Application even after the lapse of 40 days.

    In the above circumstances can I

    (a)Go for an appeal with the FFA U/S 19(1)
    or
    (b)Complain about the PIO with State Information Commission.
    or
    (c)Issue notice to the PIO/FAA under CP Act 1986.

    Looking at the nature of the information sought it appears that invoking Sec 7(9) in this case is justified. This could have been done by the PIO himself instead passing on the buck to so many subordinates. From this point of view you can go for first appeal for delay/non-furnishing of information. But ultimately you are likely to loose the battle. If you had concentrated at one or two petrol/diesel pumps you could have got some response. With the type of your query there are various ways of denying the information by the PIO. He has not acted smartly.
