Need Help: Old Age Pension

Sir,

I filed a RTI with District Social Welfare Officer (Deptt of Social Welfare Govt of Delhi) for details of pensioners in my village. Even on 02 May 2012 also directed PIO to provide the info. However the PIO did not supply info but referred Supreme Court order on RTI Appeal No 6454 of 2011 that says "At this juncture, it is necessary to clear some misconceptions about the RTI Act. The RTI Act provides access to all information that is available and existing....and where the information sought is not part of the record of a public authority, and where such information is not required to be maintained under any law or the rules or regulations of the public authority, the Act does not cast an obligation upon the public authority to collect or collate such non available information and then furnish it to an applicant.......


Please advise further action.

File first and then second appeals with state information commission. PIO can deny information u/s 8 and 9 only as mandated in section 7.1. Please refer:
