(Tentative translation for the sake of understanding of above decision)-

Appellant had asked on 17.4.10, information about action taken on his letter dt 27.3.10 to Director Local Bodies dept, Jaipur (complaining about illegal construction by Municipality, Khetri).

Appellant submitted that he has not been given any information and Municipality Khetri did not do anything to stop illegal construction which has been completed.
Respondent PIO submitted that he had forwarded letter mentioned in RTI application to Municipality Khetri for appropriate action, therefore appellant has to seek information from Municipality Khetri.

SIC did not accept this submission of PIO saying Respondent office is controlling officer and HOD for Municipality, Khetri , had a responsibility to act fast on public interest matter, which has resulted in illegal construction. In such situation objective of providing information becomes of no value. Finally SIC ordered Director Local Bodies, to enquire on appellant’s application and take departmental action if any subordinate has been found lax on the matter and report the same to SIC too.
