income tax officer states in response to rti that it return is not on record. what further to do?

dear sir,

i seek guidance

i filed an rti app for information on status of refund for ay 08-09 which is time barred now.

i had filed the original it return for ay 08-09 on juned 30, 2008 and the revised return for auy 08-09 on 31.03.2011.

the return became time barred on march 31, 2011.

as i did not get any refund of rs 15888/- plus int i filed an rti app on may 15,12 seeking status of the it return.

before that they asked from my lawyer for the revised it return for ay 08-09 seeking that they need it to expedite the refund since they do not have it on records.

being a friend the i t lawyer of kine i gave him a zerox of the revised it return.

they took advantage of it and in their own records they concocted the assessment for 08-09 before submission of the revised return, through which a demand concocted again was raised.

they have not given this record to me of my assessment before the revised return was filed but have given it to the in come tax ombudsman who has forwarded it to me.

THE IT AUTHORITES HAVE ADMITTED THAT THEY DO NOT HAVE THE ORIGINAL 08-09 RETURN IN RESPONSE TO MYH APP AND SENT ME THE COPY OF THE REVISED RETURN WHICH THEY ADMIT IN ANOTHER LETTER WAS PROVIDED TO ME.

i have in my rti app sought both the or and the revised return with encls which they have not given.

my query is

1. since they have sent a concocted document to the ombudsman and not to me showing dues from me instaed of refund how do i act?

they have also stated in their reply to my rti app that no refund is pending for the above period.

kindly advise how to actl

it is true that they are determined to concoct records.

Why not get it from Ombudsman using RTI . It is supposed to be your own ITR .

It is better if you consult an IT Consultant .
