flat owners association
we are residing in a well known apartment in visakhapatnam for last 8 yrs. we have been paying the maintenance, without fail. the present dispute is, the association has decided to buy a new generator, for which they asked all the owners to pay a particular amount per flat, as our owner has raised a question of instead of going for a new generator , they can give 24 hrs water and increase the maintenance, which they agreed and did but still they went ahead, for the new generator but our owner denied to pay the amount as he found it unnecessary expenditure, what ever the disputes they may have, now the Association has put a notice on the board saying that they will cut the electricity and water for the flats he owns as means of recovery.
my question is can the association whether or not registered under the law, has the authority to cut the basic amenities in case of any dues from the owner? when the maintenance is being paid ? when the maintenance is not paid ? what are the legalities and what a resident can do to sustain the facilities ?
