ACB finds prima facie something wrong


RTI Activist from Bikaner, Goverdhan Singh had filed a appeal with the Information Commission that information was not provided to his wife on time.

On 22 February 2011, the Commission ordered that the police was at fault and let them off with a warning and ordered that information has to be provided free of charge in 21 days.

On 15 April 2011, the Commission changed its orders and remanded the matter back to the FAA.

Appellant approached the Magistrate of ACB Court, who ordered an ACB enquiry.

The two orders are not signed.

Cause list shows that the case was only listed for hearing on 22 Feb 2011 and not on 15 April 2011.

File cover gives date of decision as 22 Feb 2011, which has been cut and 15 Apr 2011 has been over written on it.

On 15 April, the previous CIC (Mr Kaurani) was demiting office.

Commission refused to provide relevant recorsds to ACB for investigation and hence ACB could only come to a prima facie conclusion.

ACB has said that the whole process looks irregular.

Why don't you file RTI to "inspect" the hard disk and take soft copy on CD/DVD ?
