I am living in a Co-operative Housing Society. I had stopped paying society's monthly charges from Feb-2012 giving written notice to the Chairman of the society mentioning the reasons very clearly, which includes follows :
1) The surrounding area of my Flat (which is at the back side of the building) is not getting cleaned regularly, causing health problems to me/my family members.
2) The Society has rented some open space of the society (again at the back side of the building, which is, in fact, in front of my flat) to M/s Tata Indicom for them to use it for commercial purpose. They have built an unit there, having fitted Split Air Conditioner. The fans of this AC unit are causing lot of noise & disturbing the piece. When the resolution was passed, in one of the society's meetings) to rent this open space, I had not signed the paper asking consent of the Society members. However with majority of members signing in favour of the resolution, the open space was rented about 2.5 years back & since then it a problem to me. Because apart from the noise of the fans, the area where this unit is built is not getting cleaned. I doubt the legal standing of this rental agreement.

However despite resolving any of these issues till date, the Society authorities have served me with the show cause notice last moth as to why an legal action can't be taken against me for not paying the monthly charges. This notice was served to me on 14th of June-2012, giving reply dead line as 16th June-2012. I had given the reply on 14th June-2012 itself mentioning the above reasons again in more detail.

However to this also no reply has been given to me till date & now they have started harrassing me by not lifting the daily garbage from my flat only.

I need a help from the experts as how to proceed in this matter further.

Kindly note that till Feb-2012 I was the regular payer of the monthly charges of the society. Now also the paying of monthly charges is held back only because the society authorities are not taking any action to resolve the problems faced caused to me. I have no intentions to NOT TO PAY THE MONTHLY CHARGES.
