Rti helpful in solving tenant problems

In my complex a tenant is running the furniture business . Since he failed to pay the rent for past three months as per rent agreement conditions I asked him to vacate from my building. But the my tenant refused and send the lawyer notice to me stating that, he filed the suit in district court mentioning the suit No.437/2012 under rent control act.,I tried to solve this issue out of court amicably. But he refused to vacate even after my request and says that he already filed a suit. I waited for 15 days from the date of lawyer notice and there was no (summon)communication from the court about the suit filed by my tenant. I approached the district court in person and made sure there was no such suit filed in that number, against my name.

And I filed the RTI application with the PIO of district court and I got the reply from the PIO , there is no such suit filed against my name. With this record which I got with the help of RTI Act,I send the lawyer notice to both my tenant and the tenant's lawyer, stating why they should not be penalized for giving such false information. Immediately my tenant and his lawyer approached me and they agreed to vacate my building with in a week time , they also promised the same in writing.

You can file complaint before bar council against advocate under section 35 of Advocate of act 1969 for his wilful misconduct by advocate for giving false court case reference.
