Information Commissioner Information Commissioner passing illegal order and harassing the applicant
I came across a according to me a strange order No.CIC/SS/A/2012/001603 Dated: 10.07.2012 passed by the Hon'ble Information Commissioner namely Information Commissioner.
Facts as quoted by the Hon'ble Commission "The Commission has received an appeal dated 28.2.2012 from Mr. Rameshwar Sharma against Delhi Police for deemed refusal to his RTI request dated 18.10.2011 and first appeal dated 11.12.2011." The Hon'ble Commissioner should have taken steps in terms of section 20 of the act.
The said commissioner referred the appeal to the CPIO and directly asked applicant by directing him to following the all steps again. While it is crystal clear case harassment by the concern PIO for deemed refusal to RTI request.

First Thought came to mind that perhaps some technical steps (First Appeal ???) has been missed, however when I observed that commission has registered and decided this as appeal, after noting First Appeal, all doubts got cleared.Sponsorer

D/Membes,
ICs have a ready made format to decide for complaint u/s 18. In order to avoid multiple proceedings......so & so!!
The Appellant filed information request--No Reply---Filed First Appeal---No Response----Filed Second Appeal.
After 10 months of waiting.......No punishment for deemed refusal?? !!! At most the Appellant would get information (Lucky this time, if not False/Misleading/Incomplete).
The consequence: Next time for all information requests, the errant PIOs are encouraged to sit on RTI applications for Years till IC Order comes.
In one of my case, Hon'ble IC needed evidence of corruption to disclose some trivial information from CISF. I was not present in the argument.
One expects Information through RTI as evidence to fight against corruption. if evidence is again needed to obtain information, then think what will be the fate of RTI!
Exercise your Right To get Information by holding Govt. accountable to the governed.

RTI User is today pitted against not only the errant PIOs , but the Information Commissioners too .
Destroy the very system from where you are earning your lakhs !
What a predicament !
The possible solution is to collect a bouquet of such illustrious Orders from the CIC site [ may be 10 ] and present it to the High Court in form of a PIL to lay down the standards for future . An IC must be trained in law for at least 1 year before he / she steps in the office .
