    Dear all

    Please find attached herewith Guidelines for the Officers designated as first appellate authority under the RTI Act, 2005. Extremely Relevant stipulations are being extracted herein below for your kind reference

    Disposal of Appeal
    38. Deciding appeals under the RTI Act is a quasi-judicial function. It is,therefore, necessary that the appellate authority should see to it that the justice isnot only done but it should also appear to have been done. In order to do so, theorder passed by the appellate authority should be a speaking order glvmgjustification for the decision arrived at.

    40. If an appellate authority comes to a conclusion that the appellant should be supplied information in addition to what has been supplied to him by the CPIO, he may either (i) pass an order directing the CPIO to give such information to the appellant; or (ii) he himself may give information to the appellant while disposing off the appeal. In the first case the appellate authority should ensure that the information ordered by him to be supplied is supplied to the appellant immediately. It would, however, be better if the appellate authority chooses the second course of action and he himself furnishes the information alongwith the order passed by him in the matter.

    There is no dearth of instructions and guidelines. But how many read it and after reading how many follow that? That is where the need to proper training comes. It is still lacking. Passing some sort of a course on RTI, such as the online course on RTI conducted by DOPT, should be made compulsory for all PIO and AA to begin with and for all officers slowly.

    A good suggestion but Why a training at the cost of money of ours!!!!!! instead of it a syllabus of commonly used principal in judicial decision making process be developed. Prospective candidates should prepare themselves for a written as well as exam to be selected similar to IAS or IPS exam or judiciary exam. Because ultimately they get a handsome salary for doing the JOB.

    Answer sheets written exam and video interview be thrown in public domain to avoid any partiality . Any more suggestion(s) will be highly solicited.

    At least training of Information Commissioners before they start any hearings should be made compulsory.

    Similar training for staff of the Information Commisisons.
