Need Help: FAA denies PF details of estranged wife u/s 8(1)(j) and 8(1)(e) - Please Help me

Hi Friends,

I had filed an RTI application with the Employee Provident Fund Organization (EPFO) department in order to get the PF details of my estranged wife. In support of my appeal I had listed various CIC decisions which overwhelmingly state that PF details of wife could be given to the husband. Inspite of this the CAPIO denied giving the information saying that form no. 2 and form 5/10 cannot be obtained form the organization so they do not have the details of my wife. I had filed a first appeal. I was called by the FAA four times and in those 4 times I was harassed, humiliated by the FAA and he spoke to me in a very derogatory manner. Inspite of my best efforts and giving references of various CIC decisions he has denied the information u/s 8(1)(j) and 8(1)(e) of RTI Act 2005. The various CIC decisions overwhelmingly support that 8(1)(j) cannot be used to deny the information.

I would like to know from the esteemed group members how should I put forward my defense against the FAA decision to deny the information u/s 8(1)(e) of RTI act 2005. Can the EPFO dept. refuse the PF information of my estranged wife u/s 8(1)(e). Does PF information comes under section 8(1)(e)?


Please Please do help. I am filing my Second Appeal against the EPFO department.

Hi Raveena,

I am already in the process of filing my Second apepal with State Information Commission (SIC).

I would just like to know what arguments should I give in Reasons/Grounds of Appeal to counter the FAA rejection u/s 8(1)(j) and 8(1)(e) of the RTI act?

Is FAA correct in deniying the PF details of my estranged wife u/s 8(1)(j) and 8(1)(e) of the RTI act ?

Can PF details of the legally wedded wife be denied to the legally wedded husband ?

I had attached the judgments which say that PF details of the wife should be give to the husband still the FAA concluded that since the respondent had made strong objections against providing the requisite information and u/s 8(1)(j) and 8(1)(e) he has concluded that the information cannot be given. He also concluded that the CIC judgments given by me has no relevance in my case while the judgment Decision No. 1816/IC(A)/2008 F.No. CIC/MA/A/200700583 exactly matches with my situation in which the PF details of the wife was given to the husband.

Please do guide me. I need to submit my Second appeal in a couple of days.

Second Appeal in case of EPFO will be with the Central Information Commission (CIC) and not the SIC.

Can u plz cite the said CIC decisions against use of 8(1)(j) to deny the information?
