    Providing false information to the CIC by CPIO

    I had approached the CIC against the decision of the FAA Air HQ New Delhi regarding payment of interest on my delayed pension and denying me certain information. The CIC had heard the case on 6 Jun 2012 where I was unable to attend as their letter reached me just one day prior and it was not feasible for me to travel to Delhi. The CIC letter was dated 30 May and it reached me on the 5 Jun evening.
    The case was heard by the CIC and a decision has been conveyed based on the false information given by the CPIO Air HQ. The CPIO had stated that the appellant's pension got delayed by about 7 months and has now been paid. The CIC has closed the case on the grounds that " The matter is urely departmental in nature. As the appellant has already got his pension, his grievance stands redressed and that as stated by the CPIO no provision exists for payment of interest on delayed pension." This is absolutely a false statement since Min of Defence has issued a letter to this regarding interest on delayed payments of non effective benefits over a decade ago.
    What is the remedy? Can I write to the CIC on this with proof?

    Dear Mohan-ji,

    Earlier, I too missed the opportunity of hearing exactly for the same reason. However, the decision went in my favour.
    For your case, if you feel you need another opportunity for hearing, you may do so.

    1) Send another Appeal/Complaint mentioning 'adjunct to file No.xxxxxxx'

    2) Describe the whole matter (false description by CPIO) along with your cause of non-appearance.

    3) Do mention the following Rules by DOPT(para 7(3)), as followed by CIC while accepting the Appeals. This time clearly mention that you need to be informed before one month. Or you may avail the oppurtunity of video conference through NIC terminal at Pune (or other choice).
    4) After getting a Diary No., file another RTI (with IPO of Rs 10/-) to CPIO of CIC, enquiring Daily progress report of the Diary No.

    G.S.R. 650(E).

    ....7. Personal presence of the appellant or complainant.- (1) The appellant or
    the complainant, as the case may be, shall in every case be informed of the date of
    hearing at least seven clear days before that date.
    ...(3) Where the Commission is satisfied that the circumstances exist due to which
    the appellant or the complainant, as the case may be, is being prevented from attending
    the hearing of the Commission, then, the Commission may afford the appellant or the
    complainant, as the case may be, another opportunity of being heard before a final
    decision is taken or take any other appropriate action as it may deem fit.
