    SCALING formula (if exists) of UPSC has to be disclosed

    "We have carefully considered all the submissions made before us. While
    admitting the fact that the UPSC does not retain the raw marks awarded to any
    candidate after the same gets moderated in order to arrive at the final marks,
    we cannot appreciate the fact that the formula employed for such moderation
    should not be available or disclosed. Besides, the evaluated answer sheet in
    the case of the present Appellant should have been ordinarily preserved since
    the appeal process was not yet over. The Respondents, however, pointed out
    that the Appellant had never sought the copies of the evaluated answer sheets.
    This is not a satisfactory explanation for destroying his answer sheet. Since the
    marks awarded to the Appellant in various papers could be found out only in the
    evaluated answer sheets, in our view, those should have been preserved
    pending the final decision in the case.

    However, now that they have been
    destroyed, nothing can be done to retrieve those. This leaves us with the
    formula which the UPSC might have adopted in order to moderate the now non
    existent raw marks. We are of the view that this must be disclosed. We direct
    the CPIO to write to the Appellant within 10 working days of receiving this order
    and to communicate to him the formula, if any, employed by the UPSC for
    moderating his marks in the civil services examination 2010. If no such
    formulae exists in material form, the CPIO shall also inform the Appellant about
    that."
