Information related to gifts by PA is disclosable particularly since the expenditure on these gifts has been met from public funds.
Appellant stated that as per the information received by
him no suits were presented to the delegates, however he had
photographic proof that cream colour coats were presented to
all the dignitaries. CPIO stated that he had truthfully
submitted that no suits were presented on the occasion.
Decision notice
7. Commission expresses displeasure at the manner in which
the CPIO has handled this RTI application and has, by sticking
to the wording of the RTI application attempted to obstruct
disclosure of full and factual information to the applicant as
per the true spirit of the Act.
8. CPIO has not denied that coats were in fact gifted to the
dignitaries but failed to disclose the same as the appellant
had listed “suits” in his RTI application. Such a approach of
the CPIO is seen as obstructionist and willful non disclosure
of information that was disclosable particularly since the
expenditure on these gifts has been met from public funds. He
is warned to be more careful in future.
9. CPIO is directed to provide full and complete information
regarding expenditure incurred on all types of gifts
incoluding coats at the above mentioned conference to the
appellant within 2 weeks of receipt of the order. Furthermore
Commission notes that while replying to the applicant vide
letter dated 31 March 2011 the former CPIO has not given his
name and has only scribbled his signature which is eligible
and does not give out the identity of the CPIO.
10. CPIO is directed to ensure that his name is clearly
written below the signature in future.
